Lessons in this course
1. Is small claims right for you?
Small-claims courts are state or local courts designed to resolve smaller money disputes quickly, with simpler procedures and lower fees. Typical cases include unpaid bills or loans, security deposits, property damage and consumer disputes.
2. Filing and serving the claim
First, send a short written demand to the other side; some courts expect it and it may settle the dispute. Next, file the court’s claim form in the right court, usually where the defendant lives or does business or where the events happened, and pay the filing fee or ask for a fee waiver.
3. Preparing and presenting your case
At the hearing, rules of evidence are usually relaxed, but the judge still decides based on proof. Stay calm, answer the judge’s questions directly and do not interrupt. Many courts also offer mediation on the day of the hearing, which can end the dispute faster.
4. After the judgment
Winning a judgment does not automatically put money in your hand. If the other side does not pay, you may need to use your state’s collection tools, such as a wage garnishment, a bank levy or a lien on property. Courts usually provide forms for these steps.
5. Putting it into practice: a small-claims checklist
Now that you know the rules, this lesson turns them into steps you can follow. First, work through the checklist in order. Then, before you file or serve anything, compare your work with the common mistakes below and with your court’s own rules.

When you finish, take the quiz to check your understanding. After that, keep going with the related pages in the Motions & Procedures library, the Legal Glossary and the Research Center. For the official text, read the current federal rules on uscourts.gov, and also check your own court’s local rules.
Lawtopolis provides legal information and education, not legal advice. Rules change, so check the current version of your court’s rules before you file.
